DraftKings sued New York Attorney General Eric Schneiderman last week after he ruled that the daily fantasy company violated state gambling laws and ordered it to discontinue operations in the state, according to USA Today.
The DraftKings lawsuit implores New York’s Supreme Court to nullify Schneiderman’s ruling, which the company believes violates the state constitution.
“Today, we have taken decisive legal action to prevent a unilateral, misinformed and legally misguided attempt by the New York Attorney General to act as ‘judge, jury and executioner’ for daily fantasy sports in New York,” DraftKings said in a statement. “We are confident in our legal position and intend to continue to fight to preserve the right of the over 500,000 New York consumers to play the fantasy sports games they love.”
In his ruling, Schneiderman said he believes daily fantasy games are chance-based, while DraftKings and other similar companies claim they are skill-based. — J.B.
